The present document referred to in the site's General Terms and Conditions of Use aims to inform you of our practices for the processing and protection of your Data as defined below collected from the site
abo.moniteur.net, with the fullest respect for your rights.

1. Definitions
"@Uctionspress" / "We": The Services are provided by the company @uctionspress, an SA (public limited company) with capital of 140,800 euros, located at 18-20 Montmartre - 75009 PARIS, listed on the Paris Trade & Companies Register under number 682004338.
"Account": Account of a Registree on the Site.
"
Auction House": An auction house is a natural or legal person organising auctions. It uploads Catalogues to the Site for Users.
This person may be:
- An Auction House organising auctions in accordance with the rules stipulated in Articles L.321-1 of the French Commercial Code;
- A Judicial Auctioneer, public and ministerial officer responsible for carrying out the appraisal, valuation and judicial sale at a public auction of furniture and personal effects whose activity is governed by the laws of 10 July 2000 and 20 July 2011;
- Any person entitled to conduct an auction in any other country and, in particular:
- In Belgium, any person who has requested the presence of a ministerial officer for the registration of the auction in the minutes;
- In Italy, any company registered as such having obtained a commercial sales licence issued by the Chamber of Commerce and a public safety licence issued by a special police service;
In Germany, the Versteigerer, the counterpart of the French auction house, is an independent professional with more than 25 years of good character which has obtained an administrative licence to auction."
Data": means all information making it possible to identify, directly or indirectly, a natural person by reference to an identification number or to one or more elements specific to them. You will never be asked to provide so-called "sensitive" personal data, such as your racial or ethnic origins, your political, philosophical or religious opinions, or concerning your income or tax situation.
Your Data is only collected for the strict use and understanding of the Site as well as the purposes described in Article 0.
@uctionspress acts as the controller of your Data that is collected when using the Site in order to provide you with the Services. This means that @uctionspress is responsible, in particular, for its collection, security and use for purposes described herein in accordance with the data protection rules. @uctionspress does not rent or assign its customer files to third-party companies unrelated to the Services as defined herein.
"Newsletter": Informative, promotional or advertising email sent by @uctionspress to Users who have communicated their Data concerning the Services.
"Registree": any User, with or without a Subscription, having created an Account on the Site.
"
Services": @uctionspress provides you with the Site allowing you to enjoy free services and paid services as described in the General Terms and Conditions of Use;
"Site" : Website accessible at the address
https://www.gazette-drouot.com to which the General Terms and Conditions of Use apply.
"Subscriber": A User who has completed a subscription form and validated the payment and has an Account to manage the subscription.
Subscription: any User has the possibility of taking out, via the Site, a Subscription to the magazine "Le Moniteur des Ventes".
"User"/"You": means any person using the Services of the Site.
2. Legal basis
The provision of the Data is necessary to enable @uctionspress to perform the Services and to ensure the proper functioning of the Site.
In the context of taking out a Subscription, a paid service of the Site, the User is invited to become familiar with the procedures for processing their Data in the General Terms and Conditions of Subscription.
3. Data collected
We are liable to collect the following categories of Data:
a. Browsing on the Site
Login data. Whenever you log into the Site, we passively collect information such as, but not only, your computer's IP address, the date and time of login, and information about your browser.
Browsing data. We also collect information to identify how you access the Site, what pages are viewed and for how long.
We may use cookies as specified below.
b. Identification data and account creation
In accordance with the General Terms and Conditions of Use, when you create an account to enjoy the Free Services on the Site, you will be asked to enter your email address and password.
In the case of signing up to a paid Service such as a Subscription, a certain amount of Data is required, including your full name, your postal address, your email address, your telephone number and date of birth, etc.
c. Bank details
When you sign up to the online subscription paid Service, your bank details are required to pay for your Subscription and its renewal.
However, this Data is transmitted directly to the payment service provider of @uctionspress, the company Ingenico, certified PCI-DSS through its own services.
4. Purpose of collecting your Data
Your Data is collected to enable us to provide you with the Services and to fulfil one or more of the following purposes:
- Creation of an Account;
- Allow the use and operation of the Site, including identifying, delimiting and removing malfunctions and errors, while detecting any illegal use of telecommunication systems and services;
- Ensure the proper performance of the transactions initiated by the Users;
- Performance of Services;
- Identification of Subscribers responsible for unpaid invoices in a file;
- Offer an efficient customer service, particularly in terms of help with using the Site, and complaints management;
- Constitute a file of Users, customers and prospects;
- Send Newsletters, solicitations and promotional messages according to the preferences selected when registering on the site among the categories of items offered under the conditions detailed below or the behavior observed during your navigation (“Newsletter”),
- Suggest, when you connect to the Website, items according to the preferences defined by you during your registration or observed during your navigation,
- Establish business statistics and the numbers using our Services internally;
- Manage any disputes transmitted by the Auction Houses regarding the use of our Services;
- Fight against fraud;
- Manage your requests for right of access, rectification and opposition to the collection of your Data;
- Respect our legal and regulatory obligations.
When we collect your Data, we inform you whether certain Data must be completed or is optional. If you do not fill in these required fields, you will not be able to access the Services or subscribe.
5. Data recipients
a.Auction houses
To learn more, we suggest you read their privacy policies, so you will be familiar with how Auction Houses use your Data when they act as a data controller for holding sales, declaring an item sold, payment and delivery of the lots to the successful bidder.
We can only share your Data with Auction Houses as business partners, for direct marketing purposes with your express agreement by means of a box you tick when creating your Account on the Site or subscribing to a Newsletter. When you have given us your consent, we undertake to only share your Data with Auction Houses and Art Market Professionals who use our Services.
b. The Router/Printer
The Router, responsible for the printing, film-wrapping, classification and transfer of Magazines to the Post Office for Subscribers.
It has access to Subscriber data such as names and addresses to ensure the delivery of Magazines.
c. The Carrier
The Carrier is responsible for the transport of Magazines received by the printer to the addresses of Subscribers who have requested its services.
It has access to Subscriber data such as their addresses and telephone numbers and any other indication related to delivery provided by the Subscriber for the delivery of the Magazines.
d. Our service providers
We share your Data with our own service providers located in the European Union, particularly to perform services and actions at the request and on behalf of @uctionspress, such as checking the validity of your telephone number, sending promotional or marketing emails or text messages or to manage your transactions.
The Subscription management company collects your Data in order to manage the delivery of Subscriptions, their renewal and their payment.
Our service provider Selligent also uses your connection data to establish your preferences in terms of items categories. Drouot SI will thus be able to send you Newsletters corresponding to these preferences.
We use and process your login data to identify, delimit and eliminate malfunctions and errors in telecommunication systems.
We may also use login data to detect unlawful use of telecommunication systems and services.
e. Drouot Group companies
Since @uctionspress is a subsidiary of the Drouot Group, it will be able to communicate your Data to any Drouot Group company, once you have ticked the corresponding box, in order to inform you about the services offered by Drouot Group companies.
f. @uctionspress business partners
When the Subscriber has ticked the appropriate box and has consented to their data being forwarded to @uctionspress business partners for canvassing, @uctionspress will be able to transmit the Subscriber's contact information to other journals so that the Subscriber can be offered a subscription to them.
g. The judicial authorities
In accordance with the legal provisions in force, @uctionspress may be required to provide information to the competent authorities and courts for the purposes of criminal prosecution. @uctionspress may not inform you of the disclosure of your Data to authorised third parties.
6. Data storage time
We only retain your Data for the period required to perform our Services and up to three (3) years after the last use of your Account.
At the end of this three (3) year period, @uctionspress may contact you again to ask you if you wish to continue receiving information about @uctionspress Services. In the absence of positive and explicit action on your part, the Data concerning you will be archived or deleted in accordance with the legal provisions in force.
In the event of a breach of the
General Terms and Conditions of Use or this
Privacy Policy, @uctionspress reserves the right to suspend or permanently deactivate your Account under the conditions described in the General Terms and Conditions of Use.
At the end of this period, @uctionspress undertakes to erase or anonymise the Data that it has in its possession.
7. Closing the Account
If you have created an Account, and want to close it, write to us at the address shown in Article 14.
Once your request has been received, we will deactivate your Account and, unless there are grounds for the retention of all or part of your Data, we will then delete your Data within the time period specified in Article 10
8. Security
We have put in place technical and organisational security measures to ensure the security, integrity and confidentiality of all your Data to prevent it from being lost, stolen, damaged, misrepresented or distributed to unauthorised people.
In addition, it is your responsibility to ensure the confidentiality of the password allowing you to access your Account. Do not share this information with anyone. If you share your computer, always remember to log out before leaving the Site.
We do not have access to your password. Therefore, we cannot send you your password if you forget it. You can change it at any time on the Site via the password reset procedure.
We store your Data on servers located in the European Union.
9. Cookies
Cookies are text files stored in your browser. They are created when a User's browser loads a given website: the site sends information to the browser, which then creates a text file.
Every time you return to the same site, the browser retrieves the file and sends it to the website's server.

10. Rights of the user
It is possible to unsubscribe from Newsletters at any time in your Account or by clicking the unsubscribe link at the bottom of the emails received.
In the event of a problem using the unsubscribe link, you can also unsubscribe by sending a message to the following address:

More generally, you have a right of access, rectification, erasure, limitation of processing and a right to the portability of your Data which can be exercised by contacting us by email at the following address:
abonnementmdv@drouot.com, or by post at the address indicated in Article 14. @uctionspress reports back on the action taken within one (1) month of your request.
. Requests to limit the processing or portability of Data are exercised under the same conditions. This period of one (1) month may nevertheless be extended by two (2) months provided that you have previously been informed of the reasons for the postponement within one (1) month.
You may also object at any time to the processing of your Data to which you have previously consented specifically for prospecting purposes.
@uctionspress provides you, free of charge, with information about stored Data concerning you. The information can be provided electronically if you wish.
For your security, please understand that in the event of a request for information or modification, we must verify your identity. Your ID will not be retained following your request.
@uctionspress undertakes to notify all recipients of the Data processed of your request.
11. Fate of data after death
You have the right to define, with your specific consent, guidelines for the retention, erasure and communication of your Data after your death. You may change or revoke these instructions at any time.
You can designate someone to carry out your instructions. This person then has the capacity, on your death, of taking note of the guidelines and requesting their implementation with @uctionspress. In the absence of designation or, unless otherwise directed, in the event of the death of the designated person, your heirs are entitled to become familiar with your instructions and ask @uctionspress to implement them.
In the absence of instructions or if otherwise stated therein, your heirs may exercise your rights to the extent necessary to:
- The organisation and settlement of your estate. In this respect, your heirs can access the data processing that concerns you in order to identify and obtain information useful for the liquidation and division of the estate. They may also receive communication of digital assets or data representing family memories, transmissible to heirs;
- Consideration of death by @uctionspress. In this respect, your heirs may have your Accounts closed, oppose further processing of your Data or have it updated.
When your heirs make the request, @uctionspress will have to demonstrate, at no cost to the applicant, that it has proceeded with the operations required by the heirs.
Disagreements between heirs as to the exercise of these rights are brought before the competent district court.
12. Modification of the privacy policy
@uctionspress reserves the right to modify, at any time, the Privacy Policy which remains applicable for the duration of use of the Site and the Services. If modified, @uctionspress will inform you by email.
If you decline these modifications, you undertake to stop using the Services. Otherwise, your use of the Services is subject to the terms of the new version of the Privacy Policy.
Any access to the Services upon notification by @uctionspress of the new version of the Privacy Policy constitutes your full acceptance of this new version of the Privacy Policy.
The new version of the Privacy Policy applicable to the Services is available on the Site. @uctionspress invites you to consult it when opening an Account on the Website and subscribing for Services.
@uctionspress also reserves the right to modify or suspend, without reason, all or part of the Services.
Any modification or deletion of the Services does not grant you a right to any compensation for any reason whatsoever.
13. Disputes
In the event of a dispute regarding the use of their data, the Subscriber may appeal to the CNIL (French data protection watchdog).
